Welcome to Code School Canada. These Terms and Conditions ("Terms") govern your use of our website codeschoolcanada.net, our learning platform, and our educational services. By accessing or using our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not use our services.
1. Acceptance of Terms
By creating an account, enrolling in a program, or accessing any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Code School Canada Inc., a corporation registered in Ontario, Canada.
If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction
- Have the legal capacity to enter into binding agreements
- Not be barred from using our services under applicable law
- Provide accurate and complete registration information
For participants under 18, a parent or legal guardian must accept these Terms on their behalf and supervise their use of our services.
3. Account Registration
To access certain features of our services, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password confidential and secure
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.
4. Services Description
Code School Canada provides software development education through:
- Online and in-person courses and bootcamps
- Auto-graded coding assignments and projects
- Mentorship and instructor support
- Career services and job placement assistance
- Access to our learning management platform
- Community forums and networking opportunities
We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to enrolled students.
5. Enrollment and Payment
Program Enrollment
Enrollment in our programs is subject to availability and completion of the application process. We reserve the right to accept or decline applications at our discretion.
Tuition and Fees
Program tuition and associated fees are specified on our website and in your enrollment agreement. All fees are in Canadian dollars (CAD) unless otherwise stated. Prices are subject to change, but changes will not affect students who have already enrolled.
Payment Terms
Payment must be made according to the schedule specified in your enrollment agreement. We accept credit cards, debit cards, and bank transfers. Payment plans may be available for qualifying students.
Refunds
Our refund policy is detailed in our separate Refund Policy document, which is incorporated into these Terms by reference.
6. Student Conduct
As a student, you agree to:
- Attend classes and complete assignments in a timely manner
- Treat instructors, staff, and fellow students with respect
- Submit only your own original work unless collaboration is explicitly permitted
- Not engage in academic dishonesty, including plagiarism or cheating
- Follow our Code of Conduct and community guidelines
- Use our services only for lawful purposes
Academic Integrity
We take academic integrity seriously. Violations may result in:
- Assignment of a failing grade on the affected work
- Probationary status
- Suspension or dismissal from the program
- Notation on your academic record
7. Intellectual Property Rights
Our Content
All content provided through our services, including but not limited to course materials, videos, code examples, assessments, and auto-graded assignments, is owned by Code School Canada or our licensors and is protected by copyright and other intellectual property laws.
As a student, you are granted a limited, non-exclusive, non-transferable license to access and use this content for your personal educational purposes only. You may not:
- Copy, reproduce, or distribute our content
- Create derivative works based on our content
- Share your account access with others
- Use our content for commercial purposes
- Remove copyright or proprietary notices
Your Content
You retain ownership of code and projects you create during the program. However, you grant us a non-exclusive license to use your work for educational purposes, including demonstrating examples to future students (with identifying information removed unless you consent otherwise).
8. Disclaimers and Limitations
Service Availability
We strive to maintain uninterrupted access to our services, but we cannot guarantee continuous availability. Our services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
No Employment Guarantee
While we provide career services and have an excellent job placement rate, completion of our programs does not guarantee employment. Our job guarantee, where applicable, is subject to specific terms and conditions outlined in our Refund Policy.
Limitation of Liability
To the maximum extent permitted by law, Code School Canada and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claims arising from these Terms or your use of our services shall not exceed the total amount you paid to us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Code School Canada, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or post through our services
10. Privacy
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.
11. Communications
By providing your contact information, you agree to receive communications from us regarding:
- Your enrollment and account status
- Program updates and announcements
- Administrative and transactional notices
- Marketing communications (you may opt out at any time)
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or by email to enrolled students. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using our services and contact us to discuss your options.
13. Termination
We may suspend or terminate your access to our services at any time for:
- Violation of these Terms
- Non-payment of fees
- Academic misconduct
- Conduct detrimental to other students or our community
- Any other reason at our reasonable discretion
Upon termination, your right to access our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved through binding arbitration in Toronto, Ontario, except that either party may seek injunctive relief in court for intellectual property violations.
Before initiating formal dispute resolution, you agree to contact us to attempt to resolve the matter informally for at least 30 days.
15. General Provisions
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and any enrollment agreements, constitute the entire agreement between you and Code School Canada regarding our services.
Assignment
You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
